Want US Citzenship? Call CAIR!

I can't tell you how many expats I know from Europe and Israel that can't get American citizenship to save their lives. Perhaps they should pretend to be Muslims and have CAIR file a lawsuit for them. But if they pretend to be Muslims, will they then be considered apostates when they leave Islam? Tricky. Considering apostasy is punishable by death, it's a legitimate question.

After waiting almost a year and a half for the U.S. Department of Citizenship and Immigration to act on my case, I called CAIR in January 2008. They filed a lawsuit for me in March.

By June 3, I was standing in front of a judge being sworn in as a new American citizen.

The time prior to my citizenship was an emotional strain on my family, but now I will get to enjoy the rights and responsibilities of being a citizen. For example, I will be able to vote in a crucial presidential election this fall.

I cannot express how grateful I am to CAIR for the work that they have done, not only for me, but for American Muslims just like you.

CAIR DEALS YET ANOTHER BLOW TO FREE SPEECH

CAIR is gloating over the dhimmi ruling of San Francisco (need I say more?) libtard Judge Susan  Ilston against the courageous Michael Savage. Ilston was appointed by cigar stuffing Bill Clinton.
This is a terrible blow, a terrible blow, for freedom of speech lovers
. Of course, inindicted c0-conspirator CAIR is using freedom of speech to kill freedom of speech and in  typical Orwellian double spea, calls it a victory for free speech (!).  Worse yet, the king of litigation jihad is crying about law costs and begging for infidel dollars. I guess the 50 million the Saudis gave CAIR has been spent on suing airlines,  ordinary Americans and scaring the folks.

Based on this ruling, shouldn't CAIR's lawfare aginst Savage be dismissed as well?

We hope you will join us in celebrating what many are calling a huge victory for freedom of speech. Last year during a nationally-syndicated radio broadcast, host Michael Savage screamed attacks on Muslims, Islam and the Quran.

Savage's anti-Muslim rant included: "I don't wanna hear anymore about Islam. I don't wanna hear one more word about Islam. Take your religion and shove it up your behind. I'm sick of you."

As you know, CAIR's response to these attacks, coupled with the efforts of other like-mined organizations, cost Savage advertisers like Sears, Sam’s Club and GEICO Insurance. He told reporters that he lost more than $1 million in revenue.

In response to our anti-hate campaign, Savage sued CAIR. He claimed that our replaying of his bigoted remarks infringed on his "copyright." We simply believed people had a right to hear and judge his hate-filled words for themselves.

THE GOOD NEWS: In a ruling issued on Friday, Federal Judge Susan Illston dismissed Savage’s lawsuit against CAIR.

In her ruling, Judge Illston wrote that the lawsuit Savage filed was "a dispute about...the protections of the First Amendment, protections upon which plaintiff (himself) relies for his livelihood and the airing of his radio program." Judge Illston also implied that the lawsuit may have been brought in an effort to "harass" CAIR.

We could not have won this case without the help we have received from supporters like you. Despite this legal victory, our work continues. Savage's attorney has been quoted in the media as saying they plan to file another complaint against us.

Freedom is not free. Justice does not defend itself. Lawsuits are costly. This case, part of defending the image of Islam, has channeled resources away from our normal civil rights and advocacy work. Michael Savage's malicious words are not only directed at Muslims. He has issued on-air insults against immigrants, African-Americans, women, and most recently autistic children, who he called "brats" and "morons.”

Connolly Contributor Uses Aliases and Has Links to Hamas

Washington, DC – The Traditional Values Coalition (TVC) has called on Fairfax County Supervisor Gerald Connolly to return a contribution his Congressional campaign received from a radical Islamic official and reopen the supervisors’ lease renewal of the Islamic Saudi Academy. 

A Federal Election Commission report lists “Nehad Hammad” as the Executive Director of the Council on American-Islamic Relations (CAIR) and reports that he donated $500 to the Congressional primary campaign of Gerald Connolly, chairman of the Fairfax County Board of Supervisors.

Law enforcement officials note that Hammad is an alias used by Nihad Awad who is the founder of CAIR and is listed on the group’s website as its Executive Director. Before founding CAIR,   Awad served as spokesman for the Islamic Association for Palestine (IAP) which the Federal Bureau of Investigation officials have identified as a front-group for the violent terrorist organization Hamas.

According to several sources, Awad uses the name Nehad Hammad on some official forms such as IRS documents instead of the name Nihad Awad he uses publicly as a top official at CAIR.  One former federal official refers to CAIR as “Terrorists R Us” and points to a long list of CAIR staff who have been convicted of financing terrorist activities.

“Mr. Connolly should return the check he received from Awad, Hammad or whatever his name is today,” said James Lafferty, a spokesman for the Traditional Values Coalition.

At a May hearing of the Fairfax County Board of Supervisors, Chairman Connolly attempted to bully and shout down witnesses from TVC who quoted parts of ISA textbooks.   He repeatedly accused the TVC witnesses of bigotry and yelled “slander” several times.

“The cause of Mr. Connolly’s anger and vehemence in defending the Islamic Saudi Academy is now apparent.  Are there other leaders of radical Islam involved in or financing Mr. Connolly’s campaign?

“Mr. Connolly has set a new low for what value-neutral politicians will do to raise money or pander to the most radical voting blocs.   He needs to come clean and scrub his campaign of all terrorist influence and sympathizers.

“He also needs to right the wrongs he has done and bring the same passion to reversing the decision of the Board of Supervisors to lease a former county school to the Saudi government. He tried to pawn it off on the State Department which does not have jurisdiction in a desperate effort to save face.   It is an affront to every Fairfax County taxpayer to provide classrooms to those determined to indoctrinate young people to become the next generation of terrorists.”

"The Supreme Court ruled Thursday that foreign terrorism suspects held at Guantanamo Bay have rights under the Constitution to challenge their detention in U.S. civilian courts.

In its third rebuke of the Bush administration's treatment of prisoners, the court ruled 5-4 that the government is violating the rights of prisoners being held indefinitely and without charges at the U.S. naval base in Cuba. The court's liberal justices were in the majority.

Justice Anthony Kennedy, writing for the court, said, "The laws and Constitution are designed to survive, and remain in force, in extraordinary times."

Kennedy said federal judges could ultimately order some detainees to be released, but that such orders would depend on security concerns and other circumstances.

It was not immediately clear whether this ruling, unlike the first two, would lead to prompt hearings for the detainees, some of whom have been held more than 6 years. Roughly 270 men remain at the island prison, classified as enemy combatants and held on suspicion of terrorism or links to al-Qaida and the Taliban.

The administration opened the detention facility at Guantanamo Bay shortly after the Sept. 11, 2001, terrorist attacks to hold enemy combatants, people suspected of ties to al-Qaida or the Taliban.

The Guantanamo prison has been harshly criticized at home and abroad for the detentions themselves and the aggressive interrogations that were conducted there.

The court said not only that the detainees have rights under the Constitution, but that the system the administration has put in place to classify them as enemy combatants and review those decisions is inadequate.

The administration had argued first that the detainees have no rights. But it also contended that the classification and review process was a sufficient substitute for the civilian court hearings that the detainees seek.

In dissent, Chief Justice John Roberts criticized his colleagues for striking down what he called "the most generous set of procedural protections ever afforded aliens detained by this country as enemy combatants."

Justices Samuel Alito, Antonin Scalia and Clarence Thomas also dissented.

Scalia said the nation is "at war with radical Islamists" and that the court's decision "will make the war harder on us. It will almost certainly cause more Americans to be killed."

Here here Justice Scalia! Indeed, if there were ever a case for the people of the United States to remove Justices from the Supreme Court this is it. Let's hope that Federal Judges do release these terrorists and they come and settle down - innocent babes as they are - the neighborhoods of these four clowns.

Of course as Ed notes, "This will probably derail the hearings that had just begun at Gitmo for six members of the 9/11 conspiracy. By granting the unlawful combatants habeas corpus, the court has now eliminated the main reason for the military tribunal system — and for that matter, Gitmo itself. If the detainees can access American courts, they may as well be held on American soil."

Er, that would be Khalid Shaikh Mohammed the mastermind of 9/11. How does that make you feel America? If this killer gets his case taken to US Courts get ready for the circus instead of the noose that he deserves.

By the way, in the case of an out of control system of justice the people have the right to take back the Nation. That too is in the constitution.

In a statement, CAIR National Director Tahra Goraya said:

"Today's Supreme Court decision is a victory for objective justice. Once again, the Bush administration’s weak assertion that its heavy-handed detention policy operates within the law has not found support in our nation’s highest court.

“As with the Patriot Act, the Military Commissions Act of 2006 was passed quickly without proper congressional debate. The repeated lack of appropriate legislative process and administrative double dealing has proven to be damaging to our nation.

“The prison facility at Guantanamo Bay is a legal and public relations embarrassment for our country and should be promptly closed.”

CAIR MEETS WITH JAILED TERRORISTS

According to the Tampa Tribune, CAIR Executive Director Nihad Awad and several other leaders of the US Muslim Brotherhood network met with jailed Palestinian Islamic Jihad terrorist leader Sami Al-Arian earlier this week, endorsing Al-Arian's continued obstruction of justice in refusing to divulge details of his knowledge of terrorist support operations in the US. Al-Arian has admitted to fundraising and otherwise aiding PIJ terrorist leaders - several of whom are relatives.

After their jailhouse visit with Al-Arian, Awad said that "they were there to support him". CAIR also issued a press release highlighting the meeting with the terrorist leader.

25 March 2008: A source inside the Manhattan District Attorney’s office admitted to me during a telephone conversation yesterday that “hate crimes,” specifically those occurring against Jews, are frequently omitted from such classification. Meanwhile, acts that victimize Muslims, regardless of their motivation, are usually reported as "hate crimes."

 Consequently, crimes against Jews and other religions fail to garner the same media focus as crimes against Muslims and skew the figures used to track criminal motives. Although this is not a new phenomenon, it has recently been accentuated by the incident that took place on a New York subway last week.

From the Hamas ties of its founders in 1994 to its solicitous stance toward accused terrorists today, the Council on American-Islamic Relations (CAIR) has demonstrated that its actual mission is far removed from the civil rights advocacy it claims to pursue.

Still standing as perhaps the clearest evidence of CAIR's insidious role, two key leaders of the group attended a 1993 meeting in Philadelphia called by Hamas members and supporters to devise a strategy for torpedoing the Oslo Accords aimed at Middle East peace.

An analysis of secret recordings of the meeting led the FBI to conclude that the gathering was held "to determine… [the participants'] course of action in support of Hamas' opposition to the [Oslo] peace plan and to decide how to conceal their activities from the scrutiny of the United States government."

Coupled with their support for the jihad in the Middle East, the attendees recognized the critical importance of domestic lobbying in the United States. One discussed encouraging the Islamic community "to be involved in the political life of this country," adding, "We should assist them in this task. This will be an entrance for us to put, through the Islamic community, pressure on the Congress and the decision makers in America."

That's where CAIR came in. Participants in that 1993 meeting discussed tailoring their message to an American audience, speaking of outright deception at times and of softening their rhetoric at others, as the following exchange between CAIR founders Omar Ahmad and Nihad Awad shows:

Awad: What is important is that the language of the address is there even for the American. But, the issue is how to use it.

Omar Ahmad: There is a difference between you saying "I want to restore the '48 land" and when you say "I want to destroy Israel".

Awad: Yes, there are different but parallel types of address. There
shouldn't be contradiction. Address people according to their minds.
When I speak with the American, I speak with someone who doesn't know anything. As for the Palestinian who has a martyr brother or something, I know how to address him, you see?

This context helps explain why federal authorities have tied the CAIR to Hamas in three separate court filings in the past year. Prosecutors place CAIR on the Muslim Brotherhood's "Palestine Committee." An internal Palestine Committee document in 1994 lists CAIR as one of its "working organizations" along with IAP. Other records show that committee was created to advance the Hamas agenda within the United States.

Among the highlights in today's report:

- CAIR was incorporated less than a year after the Philadelphia meeting by three officials of the now-defunct Islamic Association for Palestine (IAP), long a central player in Hamas' U.S. support network and a group that the U.S. Immigration and Naturalization Service deemed in a 2001 memo to be "part of Hamas' propaganda apparatus."

- As recently as the summer of 2007, the Dallas trial charging the Holy Land Foundation for Relief and Development (HLF) with providing material support for Hamas produced extensive evidence that IAP -- CAIR's parent -- played a central role in the Muslim Brotherhood's Palestine Committee. Much of that evidence relates to Mousa Abu Marzook, now deputy political chief of Hamas, who served on the board of directors of IAP in 1989.

There is no question that CAIR is the propaganda arm of the jihad

The Council on American-Islamic Relations (CAIR), in the past week has lobbied Congress about conditions in Hamas-controlled Gaza and urged support for convicted Palestinian Islamic Jihad operative, Sami Al-Arian. CAIR was silent in the wake of the Yeshiva attack in Jerusalem in which a Palestinian gunman murdered 8 students in cold blood, and has never called on Hamas to stop its indiscriminate rocket attacks on Israeli civilians.

Talking to government officials about the humanitarian situation in Gaza is not, in and of itself, problematic. But CAIR's efforts must be viewed in the context of their recent actions, and, more importantly, CAIR's glaring omissions.

On Al-Arian, who is engaged in yet another hunger strike while he again attempts to evade a subpoena to appear before a grand jury, CAIR writes:

His attorneys say an earlier plea agreement freed him from further cooperation with the government.

Yet the 11th Circuit Court of Appeals ruled in January that Al-Arian's plea agreement did no such thing – a development of which CAIR is very well aware.

And Al-Arian's defense attorney, Jonathan Turley, in a similar vein, is continuing his disinformation campaign on behalf of his client. Recently, on his blog, Turley wrote:

"Dr. Al-Arian began his hunger strike after the government called him before a third grand jury — prolonging his incarceration in violation of an agreement reached in Florida after the failed attempt to prosecute him for terrorist related charges." (emphasis added)

Several courts have now ruled that compelling Dr. Al-Arian to testify does not violate Al-Arian's plea, or any other, agreement. The January opinion from 11th Circuit Court of Appeals concluded Al-Arian could be compelled to testify before a grand jury, and further stated:

The exclusion of a standard plea agreement provision requiring a defendant to cooperate with the government, whether voluntarily or under subpoena, does not establish that the government immunized Al-Arian from future grand jury subpoenas. This contention is especially dubious where, as here, the plea agreement contains an integration clause stating that there are no other promises, agreements, or representations except those set forth in the agreement, and Al-Arian denied at his plea hearing that he pled guilty in reliance on any promises or inducements except for those found in the agreement.

That basically echoes a ruling by the 4th Circuit Court of Appeals in March 2007. It should also be noted that, despite Turley's assertion of that the government failed in its attempt to prosecute Al-Arian on terrorist related charges that, Al-Arian, in fact, plead guilty to a terrorism related charge: "[c]onspiracy to make or receive contributions of funds, goods or services to or for the benefit of the Palestinian Islamic Jihad, a Specially Designated Terrorist, in violation of 18 U.S.C. § 371."

But a mere conviction on a terrorism charge will not stop CAIR from supporting Al-Arian, and from attempting to mislead others about the nature of his case. And so CAIR's alleged concern for the people of Gaza, and their purported championing of human rights, rings hollow in light of the fact that they refuse to condemn the Hamas terror gang or speak up on the deadly Yeshiva attack. It chooses to expend more energy on behalf of a convicted terrorist than on the people his organization has worked to slaughter.

Remember that CAIR has been linked to Hamas by federal prosecutors on three separate occasions in the past year. Evidence produced at the Hamas-support trial of the Holy Land Foundation for Relief and Development (HLF) last summer showed CAIR was part of a Muslim Brotherhood-led "Palestine Committee" in America, created to support Hamas.

There really has never been any doubt which side CAIR is on, but now, after the last few weeks, there definitely is none.

March 10, 2008 - San Francisco, CA - PipeLineNews.org - As noted in a Council on American Islamic Relations [CAIR] press release, on February 21 members of the LA chapter of that group along with other Islamist organizations such as the Muslim Public Affairs Council [MPAC] and the Muslim American Society attended the first meeting of the Los Angeles Police Department's "Muslim Community Forum."

CAIR was named as an unindicted co-conspirator in the Holy Land Foundation [HLF] prosecution last summer and 5 of its members have been charged and either convicted or deported on terror related charges. Ghassan Elashi, the founder of the Texas chapter of CAIR has already been convicted in the Infocom terror case and is a principal in the HLF case.

The Muslim American Society is the American wing of the Muslim Brotherhood, the Egyptian based terrorist group which created among other things, Hamas, the Palestinian terror group operating in Israel's West Bank and Gaza

 

In recent years, the U.S. Brotherhood operated under the name Muslim American Society, according to documents and interviews. One of the nation's major Islamic groups, it was incorporated in Illinois in 1993 after a contentious debate among Brotherhood members." If you are scratching your head as to why the LAPD is meeting with these two terror friendly groups consider the site of the meeting.

The event took place at the Omar Ibn Al-Khattab Foundation.

The Omar Ibn Al-Khattab Foundation is a masjid, a mosque and it was built under the auspices of a program initiated by the late Saudi King Fahd [source, King Fahd's website, http://www.kingfahdbinabdulaziz.com:80/main/m460.htm] which has spent an estimated $45-80 billion worldwide to construct Wahhabist influenced mosques.

The Omar Ibn Al-Khattab masjid is not alone in this distinction, as the King Fahd Mosque in LA was also constructed under the same program. Most of these radical mosques are held in an Arabic trust - a waqf - by the North American Islamic Trust [NAIT] a Saudi dominated entity [created by the Islamic Society of North American, ISNA, an organization also named as an unindicted co-conspirator in the HLF prosecution] crafted to impose an additional layer of Wahhabist religious conformity. It is believed that approximately 80% of U.S. mosques are so held.

Clarifying this relationship between the Saudis and American mosques, an announcement on the Saudi Embassy website states:

 

"Prince Abdulaziz Ibn Fahd Ibn Abdul Aziz, Minister of State and Cabinet Member, yesterday opened in Culver City, a western suburb of Los Angeles in California, the newly-completed King Fahd Mosque, work on which began in April of 1996. The mosque, costing SR 8.1 million (U.S. $ 2.16 million), was financed entirely by private donations from Prince Abdulaziz, who contributed over one million dollars for the purchase of the land, and from the Custodian of the Two Holy Mosques King Fahd Ibn Abdul Aziz." The Saudis have used this historically unprecedented mosque building program as a form of religious imperialism, intent on spreading the most radical form of Islam throughout the United States.

The Omar Ibn Al-Khattab mosque has spawned the Omar Center for Science and Technology, the Omar Academy, the Pontifex Media Center, the Omar Center for Social and Cultural Relations and the Omar Scholars Fund, a structure designed to conduct da'wa or Muslim conversion efforts.

Most of these programs are shadowy, with little in the way of a paper trail available to assess how and to what end they are organized, however the Pontifex Media Center has been involved in creating documentaries and interviews with Islamists including a key Tunisian disciple of the Muslim Brotherhood, Rashid Ghannouchi.

ABC NEWS DOES CAIR's Bidding

Astonishing.  While Jew hating attacks are up 50% and increasing, "Islamophobia" and attacks on  Muslims are on the wane, barely a blip.  But don't let mere facts stand in the way of ABC News.  In this latest act of dhimmitude ABC News tries to shame the American people, induce baseless guilt and create the impression of islamophobia.  How opportune when folks are discussing Obama Hussein's  Islamic bonafides, eh?
Who makes these dangerous decisions to once again confuse and deceive the American people, twisitng yet again, who the  real victims are. I wonder if ABC will show the actual numbers of beatings and harassment of Jews worldwide vs baseless Muslim claims.

I'd like to see this same scenario being played out against Jews as the victims in Muslim neighborhoods. Yes, ABC News, let's see a show like that.

...What if you witnessed "Islamophobia" in action and saw someone being victimized because of someone else's prejudices? What would you do?

ABC's production crew outfitted a bustling roadside bakery north of Waco, Texas, with hidden cameras and two actors. One played a female customer wearing a traditional Muslim head scarf, or hijab. The other acted as a sales clerk who refused to serve her and spouted common anti-Muslim and anti-Arab slurs.

The polarity of reactions was shocking, from support to seething disapproval. Never did we expect customers to be so passionate or candid.

His Place, His Right

Our actor, Sabina, walked into the bakery in search of apple strudel. When she reached the counter, an actor posing as a sales clerk was quick to greet her with hateful anti-Muslim language.

"Get back on the camel and go back to wherever you came from," he said. "You got that towel on your head. I don't know what's underneath your dress. Just please take your business and go elsewhere with it."

What a set up! Can you see the fun the Muslims and the dhimmis had writing the script entitled imaginary hate?

"Sir, I am an American, I was born and raised here," she said.

The other customers seemed to hear the exchange but they barely looked toward our actors. When no one came to her defense, Sabina made a direct appeal to one customer.

"Sir, would you mind ordering me an apple strudel? That's why I am here," Sabina said.

Though visibly shaken by the hateful words, the man gave Sabina the cold shoulder, completed his purchase, and walked out of the bakery. "I really think that a person who owns his own business should be able to say who they sell to," he said after we told him about the experiment.

In fact, it is illegal for public establishments to deny service based on someone's race, color, religion, sex, or national origin, according to the Civil Rights Act of 1964. Regardless, this man was not the only customer to defend our sales clerk's "right" to discriminate. (MORE)

LIVEBLOGGING: ABC looks ridiculous. With the exception of a couple of folks ........ the unsuspecting customers stood up for the Muslim woman. The whole thing was a disgusting set up and Americans did not take the bait. Pure propaganda.

Network TV really blows. Now I know why I never watch it. Ever. What garbage.

 

CAIR'S REAL MOTIVES: JIHAD!

CAIR has recently lost its tax status. It is seemingly unimaginable that CAIR, an un- indicted co-conspirator, should have been  given the tax status which enabled it to conduct lobbying activities.

Eagle eyed reader "Archimedes2" sent me this revealing observation.  Speaks volumes to CAIR's real motives, don't you think?

I'm just passing along a response to something you posted back in October, in which CAIR cites Canadian Imam Kutty (in whom I have a particular interest). 

Sheikh Ahmed Kutty of Toronto, Canada states: "I think it is not only permissible, rather it is also imperative that we do give our zakah to organizations like CAIR…" Your donations to CAIR are also tax-deductible.

Seems nobody is paying attention to the term Kutty used, "Fi Sabilillah", which I think speaks volumes about CAIR's agenda -- seeing as they post this fatwa on their site.

Maybe their tax status downgrade is behind their attempt to enhance their zakat bona fides: CAIR is campaigning for zakat contributions under the Islamic classification of "zakat fi sabilillah" (or "fi Sabil Allah") here.

I find this interesting because of the "normative" meaning of this term in islam.  From an Islamic website:

7."Fi-Sabilillah"(In the cause of Allah)

This is a common word used in relation to all good deeds but, in particular, it means rendering help to an endeavour on to raise aloft the banner of God's religion. The Holy Prophet (peace and blessings of Allah be upon him) said that it is not permissible for any wealthy person to take Zakat but if a wealthy person requires help for the sake of Jihad, he must be given Zakat because a man may be wealthy by himself he is unable to defray from his own pocket all the extraordinary expenses entailed in Jihad. It is necessary to help him in this work from Zakat.

The Imam who gave this fatwa and his son, Faisal, are "of interest", having a bit of a history when it comes to the use and abuse of Islamic charities for fun, profit and jihad. Anyone remember the "BIF" case from a few years back?

In another online Fatwa at the Islamic Institute, Kutty confirms that the PRIMARY meaning of zakat "fi Sabilillah" in Islam is for support of Jihad:

Of course he also says that the meaning could be stretched to include "other kinds of jihad" such as intellectual jihad (schools), hospitals, proselytization, etc.

But, since this explanation DOES NOT appear in the Fatwa for supporting CAIR with zakat, does it not follow that he/CAIR intend for muslims to consider this a donation to (unqualified) jihad? That's how I read it.
 

The point is not that Fi Sabilillah ALWAYS means jihad funding -- but that this is the NORMAL Islamic meaning. Like "Jihad" they can freely use this term and say "Oh, but it can mean other, less violent things too".  It appears to be part of the whole agenda of creating a doublespeak in which they can say something that means one thing to fellow muslims but something very different to the kuffar -- who are forbidden, under pain of Human Rights complains, from making honest enquiry into the real message.

Somebody's got to publish an Islamist lexicon (for journalists), giving TWO definitions for all their terms:  one for the Muslim, and one for the kuffar.  I think I have a list of about 20 terms for it already, and I'm sure I've only scratched the surface.

Not so much for the media "Archimedes2" because they have unabashedly aligned themselves with the terror force, but for the individual that wants to save his country, his way of life.

To put it differently,the view held by the majority of scholars that fi sabil Allah is intended for Jihad is more in line with the Qur’anic usage of the term, which is always precise and specific in its terminology. At the same time, however, we need to stress most emphatically that there is no justification whatsoever either in the Qur’an or Sunnah to limit the term Jihad and struggle for the cause of Allah to warfare or military enterprise.

People can always reference a different fatwa by Muzaamil Siddiqui (Prez of ISNA), found on islamonline.net:

 

n the Qur'an, Allah Almighty has mentioned 8 categories of people who can receive Zakah. Allah Almighty says: “Alms are for the poor and the needy, and those employed to administer the (funds); for those whose hearts have been (recently) reconciled (to the truth); for those in bondage and in debt; in the cause of Allah; and for the wayfarer: (thus is it) ordained by Allah, and Allah is full of knowledge and wisdom.” (At-Tawbah :60)

The expression "in the cause of Allah" or fi Sabil Allah was generally interpreted "Jihad fi Sabil Allah" and so

Zakah expense for this purpose.

Now I don't think either Kutty or Siddiqui are OPENLY calling for donations to be made for the purposes of military Jihad. But both their rulings leave this door open.  Ostensibly both are calling for a liberal interpretation of this category so that it can be used for building projects, to support Da'wa campaigns and "nonviolent" Islamist organizations in the west -- WHILE NOT NEGATING ITS VIOLENT USE OR MILITATING AGAINST THE VALIDITY OF ITS PRINCIPLE MEANING. 

>Indeed, I would say they are trying to leverage the principle meaning into something more general.  Perhaps one might conjecture that they wish that some of the funds going overseas to terrorists would stay home and help the islamist agenda here.  One might say they are telling supporters of the Jihadists "hey we're also Jihadists".  They are placing themselves in the same category, looking for approval and financial support from those wanting to blow up kuffars around the world.

Also, this may be a play to divert money from competing islamist ideologues.  The split between Al Qaeda and the Ikhwan, for example, is well known.  CAIR and ISNA are both Ikhwan fronts and it would make perfect sense for them to divert funds that would otherwise go to Al Qaeda-supported militants, for the support of Ikhwan projects.

I think, as a more general principle, they are trying to bring the "Fi Sabilillah" category to the forefront in Muslim's minds, and to sanitize the term for the sake of kuffar.  They are also, of course, trying to increase the support base for Islamist organizations in the west, that are notoriously undersupported here (from what I know most of their financial support for operations comes from abroad).  So the face-value of their message is not an outright lie, I take it quite seriously.  But the secondary effects are clear, the acknowledgement of the main meaning is unmistakable, and it is quite inconceivable for these two Islamic scholars not to have these things in mind.
