Rifqa Bary's case is a test case in numerous ways. It involves the question of whether American courts can successfully be compelled to follow Sharia provisions regarding the imprisonment of female apostates. It will show whether the American legal system and American society are up to the challenge of defending the freedom of religion and freedom of conscience from stealth jihadists and Islamic supremacists. It will show whether Muslim girls facing a domestic situation analogous to Rifqa's have any hope, even in the Land of the Free. (Robert Spencer)
Apparently, under cover of darkness there have been a number of hearings on Rifqa Bary. Yes, without public knowledge, with NO MEDIA, Ohio has been adjudicating on Rifqa. The public hearing on the 16th was canceled, but they have been conducting hearings.
Her crime? She escaped Islam and converted to Christianity (all Atlas coverage here: Rifqa Bary: Teenage Apostate in America).
The hearing that was set for November 16th has not been rescheduled. The clerk has received no further communication from the court as to the next setting. This court does not want much to get out. John Jay, former prosecutor in juvenile court, said,"I have never ever heard of a gag order being set on a hearing date, which, in every jurisdiction or court i have ever practiced in, such matters are of public notice."
At least in Florida, they conducted these machinations in full view. Ohio does business quite differently. Rifqa is under house arrest. That much is obvious. Sharia law in Ohio.
The silence is deafening. Now more than ever, Rifqa needs our help. She cannot speak, so we will speak for her.
Rifqa is suffering at the hands of the same moral illness, the same dhimmitude that resulted in the Fort Hood jihad attack.
STAND UP FOR THIS GIRL. RALLY FOR RIFQA ON MONDAY.
We will be there at every hearing, every ruling, every motion.
They will not get away with backdoor deals to get this girl sent home.
They will hear us. They will know we are watching their every move. We will not wake up one day to find that Rifqa has been sent home to her devout Muslim household by some sharia edict set forth by the court. This is America. Whatever is done will be done in the full light of day.
I am sure you have noticed the Ohio media has been very quiet on Rifqa. Hijabed Heagney has been noticeably quiet. There is a gag order on everyone. WTF?
One November 16th hearing has been moved to December 22, 2009. This is the cause alleging Rifqa to be a wayward kind, incorrigible - the straight A, honors classes student is being sued by her devout father for being "unruly". This was the case Rifqa's parents filed against her to get her returned to Ohio from Florida. We will be at every trial.
They can bounce all they want. We are firm in our commitment and support of Rifqa.
Be there tomorrow Monday, November 16th. Say no to sharia law. Say not to an islamized America. Speak up! Stand for freedom of religion.

Pamela.....how do you find out these things? I am glad you are able to, but I am intensely curious as to how.....and am praying in, around, and despite all of what is being done to her, that beloved girl!

'The November 16th hearing has been moved to December 22, 2009. This is the cause alleging Rifqa to be a wayward kind...'
It's difficult for me to grasp what's going on concerning Rifqa.
I guess there is more than one cause going on? If so that means that Rifqa can be delivered to her murderers to be before 22nd of December?
Can John Jay tell us more ...
I can't help but I am very concerned for her. CAIR has lots of money, beware that they can buy the judge if it's all happening in the dark ...

Without knowing any of the facts it is likely that a delay in the hearing date is a good thing. The goal is for Rifqa to make it to 18 so that she is no longer a minor and can then be free of the family court altogether. The longer the process drags out the better.

Can we be told anything more, Pamela? What happened at these hearings so far? Can she be returned to her parents without anyone's knowledge before Dec. 22?

I don't know.
There's a blackout.
Everyone is gagged.

Has anyone tried to involve John Kasich? He always struck me as a straight up guy and, as Republican candidate for governor, he might be able to shine a little light on things.

Sic-'em, Pamela! You, Roger, and the rest are attending to essential business, and making a difference.

Good idea huckleberry, maybe now is the time to ask for help from government officials.
This secret hearing lark, isn't there a way of enquiring/checking at the court (even if it means a daily phone call)?
It all sounds like a Sharia cloak and dagger to me.....

Is anyone else sick and tired of our chickenshit judges and politicians dancing around the obvious??????? What kind of underhanded bullshit is this?????? I think that the end game is to put Rifqa and these rat bastard parents of hers on a flight and get them back to Sri-Lanka. Judges and politicians are guilty of the utmost worst evil in trying to get this yound lady murdered.
Islam must be taken on face to face and CRUSHED!!!!!!!
Posted by: newinnewark | Thursday, November 12, 2009 at 06:30 PM
December 22 - is that a normal time to have such a hearing? They must be hoping that all Rifqa's supporters will be busy buying their presents, and preparing their big dinner for 3 days later.

I'll be there on 11/16, Miss Pamela, with another friend and our signs in tow.
What this situation needs is a NICE BIG SPOTLIGHT ON IT.
If anyone has friends or relatives in the Columbus area, ask them to go down to the rally and represent you if you can't get there yourselves. We are all in this together.
Little Rifqa, may the God you love hold you in His hands.

In the light of the Muslim terrorist attack at Fort Hood the courts
in Ohio are playing gag order games with this case? I have said it before
if anyone knows heavy hitters like Alan Dershowitz, Barry Cohn , celebrities
like Pat Buchanan, Glen Beck , Bill O Reilly, Michael Savage, Rush, call them and try to get them come on in or at least shine a spot light in this case.
Posted by: Xavier | Thursday, November 12, 2009 at 07:35 PM
The timing of the postponed hearing is absolutely transparent. They do hope to stamp out the "watchers" and ralliers by placing it so close to Christmas. Most Americans are too busy at that time of year to fly or drive to Columbus, and those who can will find airline tickets to be at a premium. I'm still praying for Rifqa and for that miracle she deserves.

If God forbid this girl is murdered by her father, her blood will be on the hands of the media and authorities who failed to protect her in the name of avoiding any confrontation with the muslim community. Just as surely as the blood of those 13 soldiers are on the hands of the media and the authorities that failed to act to stop hassan for the same reason. And if Rifqa is murdered I doubt any of these bastards who failed to protect her, including a media which is siding with her parents, will even give a damn. They have no concience, no morals.

Here is something that has always puzzled me. Rifqa's father filed a complaint in Ohio alleging that she was incorrigible, i.e., that she would not respect or obey parental commands. I always thought that a finding that a child was incorrigible meant that the child was committed to the care of the State. It wouldn't make sense to return a child to the parents who allege that the child will not obey them.
Am I missing something here? Was the claim that Rifqa is incorrigible just the most convenient way to give Ohio jurisdiction? Is there any chance that Rifqa's father can now dismiss his complaint and the State simply return custody of Rifqa to him? If anyone has any insight into how this claim might be handled by the Ohio juvenile courts, I would appreciate hearing about it. Thanks.

Pray, Pray & then Pray some more! Islam is a False & Pagan religion & is powerless against the God of the Bible! These men foolishly strive against God but it is He who will have the last word to them & that is Guilty! Rifqa is in God's hands & I can't think of a Better place to be! Father give Rifqa your Peace & Supernatural favor at her next hearing in December & bring confusion to the Islamic lawyers sent against her-In Jesus name Amen!

Seriously, how did you find out about this? What source can we go to in order to verify this? I'm in Columbus. I call, I write, I plan to protest. But this is insanity.

Please get a correction on the post at Rifqabary.com---it says rally on Sunday.

I'm bowing out officially because I've now got a commitment to attend a meeting in Beverly, Massachusetts, on who the players are in Islamist supremacism in the greater Boston area. We still have the Sudbury Shaheed who wanted to bomb malls and is trying to get released to house arrest which would put him very close to a mosque and community facilities. They will, of course, get an earful about Rifqa if they haven't heard about her case already.
So thanks to those who offered and I'll be watching the rally blogs on Monday!

I have a feeling Rifqa will be like Terri Schiavo. The law will mean nothing for her. I am praying for her everyday.

Ms Geller has nothing to do with what I am about to say, but I must say it: I am gravely disappointed with the silence of Michelle Malkin, AllahPundit, Gateway Pundit, Rush Limbaugh, Glenn Beck, etc, on this issue. I cannot speak for the others, but I have personally emailed both Ms. Malkin and Mr Hoft (GP), asking each to cover the Rifqa Bary story. You see the results: Unless I am missing something, a virtual blackout of the story on their blogs. What is the reason for this reticence? I am baffled: The Rifqa Bary story seems "made to order" for the format and style of both blogs (Malkin and GP). Could it be that something has been said by those who are in the "in crowd" in the very clubby conservative "blogosphere" that is keeping these folks from covering this story. At any rate, I do not hate or write these people off, but -- without doubt -- their decision to spike (or, at least, ignore) the Rifqa Bary story when they might have had an influence on the outcome of her court battles is hardly their finest hour. If Rifqa meets a violent death, will they THEN cover the story? If so, it will be a bit too late, akin to shutting the barn door after the cow has gotten out. I suppose we should not be surprised: As the battle gets sharper, I suspect that the ranks of those willing to fight in the trenches will grow thinner. Ms Geller: You are a breath of fresh air. People of your character and courage simply do not come along every day!

Full disclosure, the "very clubby" description of the conservative blogosphere was borrowed from Ms Debbie Schlussel (used in one of her posts on her blog).

Pamela - if there is zero information coming out about Rifqa's current status, if none of the many friends she willingly listed in the FDLE intervew have had any contact with her, then what is to stop you (or any of them) from filing a missing persons report with the FBI? I'm very serious. The ONLY "fact" that would be holding one back would be that the state is (supposedly) taking care of her. But, you know, the Soviet state took care of a lot of people too, if you get my drift. I have ZERO confidence that Ohio is capable or willing to do right by Rifqa. Who do you turn to when your own government becomes a threat to your life? When do we begin to act as if we recognize that the social contract is broken?

Remember!!!! When Islamists butcher the innocent only Muslims suffer. The Kaffirs, not really. There the bullies. Its always a none Muslims fault.
When we have a World Leader declaring terrorism does not happen. What do we expect?
The killer if a slave of Allah always is the victim. So it seems. So Obama means.
You know Pamela I would be screamingly outraged at the fact there allowing the very murderous tormentors of New York into your city again. Its stomach churning beyond belief. A slap in the face for 9/11 family members if not all New Yorkers. I don't know how you folks stand it?
You know he's going to use the trial to clear the Islamists. Than Americas policies towards Islam. All while going after Bush appointees? The evil never ends at Motel Hussein.
I used to wonder what the Bible meant by "The seed of the serpent". I now know.

That people in America and all over the world are in hiding because they will get MURDERED by muslims for leaving islam is bizarre! Freedom to leave any religion is an inalienable right!

The big picture...The over the edge left is using Rifqa for practice, they used Hasan, the murdering terrorist, for practice, they have used all the terrorist acts committed on US soil, for practice...What are they practicing up for??? The New York trial of the 911 gang of five.
The over the edgers are trying to soften up the public, with sloganality...
Their goal is to find Mohammad 'not guilty', and then arrest Bush/Cheney and half the CIA...The good thing...sloganality can be neutralized by applications of common sense and direct action, as in the rally for Rifqa.

I am STILL at a loss here. Was she sent home because she is not a U.S. Citizen? As far as I am aware, at 17 you can leave home if you choose to do so, your parents just can't throw you out. I know that in South Carolina and Georgia that is true. I had an officer in Elberton, GA tell me that my kids could walk out if they wanted at 17 just last year! So, why are they treating her like she is a 12 y.o. runaway?

Huckleberry friend --- about 10 days ago I sent Kasich a book about Islam and a lot of pertinent articles, with a letter explaining Pamela's crusade and asking for his help and telling him to please come to the rally on the 16th --- I told him he could become America's hero and win a lot of votes if he would help rescue Rifqa --- so we'll see if he bites.

Robert Spencer is spot on in his opening summary.A class action suit needs to be filed against this "religion" and it's sharia tenets. It not only violates apostates and their right to "freedom of religion" but goes so far to threaten taxes or bodily harm to all infidels who do not submit to their calls for conversion. Women should especially take note of the abuses that sharia law dictates (just Google- wife beating+ muslim). The shocking youtube videos that come up are very offensive. America has no place for proponents of Sharia. It is time to nip this one in the bud.

gunjam, I, and I am sure many others have noticed the same, it certainly hasn't gone unnoticed.
I can only put it down to integrity, lack of.
No doubt they need a body for a story...wouldn't want to tarnish ones reputation.
Some always falter and stumble when they climb limelight ladder, when their ladder is more important than their integrity, and empathy - isn't that how the msm lost their footing.
