Okay, checked out the applicable U.S. code regarding the flag,and had this been a "real" flag to begin with, than the statutes of said code would be applicable. But it is not, nor has ever been a U.S. flag. Folks, it falls under the same heading as the bathing suits/shirts/pants and other items, even though it mimics the flag design, it is nothing more than a novelty ... granted, one done in very poor taste, but a novelty none the less. That is what any attorney worth their salt would argue in court (and sadly, probably win).

Now, having said this, what really bothers me about it, is that someone or somebodies find this "flag" to be appropriate. That they are comfortable enough in having the image of this usurper to the office of the President emblazoned on a representation of the national flag, creating something which is disgusting on any number of levels.

Still, there are issues which are far more pressing, than this. This stupidity, while disgusting, (physically) hurts no one. But things like our foreign policy being in a shambles (back stabbing Israel, unclear direction in Afghanistan, support for Islamists world wide - some cases at a tacit level- and others more overt, failure to address the spread of nuclear technology and capabilities to various rogue states and other bad actors ... the list goes ever on), our domestic policies being either torn apart, or already in shambles, or the on going direct attacks to our Constitution. All these are IMHO of far greater importance. By fighting and defeating those who are bringing all the above to pass, as a by product, you will find the flag issues taken care of as well.

Any discussion about U.S., or individual state codes here are senseless. You take such pride in your country but yet you don't take the time to understand it's governmental structure. Decisions of the United States Supreme Court define the law until such a time as Congress changes the law. Texas v. Johnson clearly controls the issue, and it's quite clear. Also, due to the theory of stare decisis, even a conservative Supreme Court won't overturn Johnson. It's not like "one case goes one way, another goes another way." That's not the way it works with Supreme Court precedent.

it would seem to me, since you couch your assertions in the context of a washington state residence, that in all likelihood mr. solomon has made no actionable threat of illegal conduct against you, promising only to "hunt you down" for the purpose of initiating "legally" permissible arrests and prosecution: in actual fact, it would not be necessary for mr. solomon to attempt an arrest at all, given that under applicable court rules he could command your presence in court to answer to a citizen's complaint. there would be no need to effect your arrest under the law to gain your presence in court, as applicable process would do that.

this is assuming that prosecution for defacing the flag could be initiated in either state or federal court. since mr. solomon has promised to act in all instances with "legality," we can assume that he would research that issue before effecting any intrusions into your liberty interests, and would act only with permissible guidelines effected by the law.

in short, i do not see that mr. solomon said anything that would have threatened you or any other person with performed illegal acts against either your person or your legal or liberty interests.
it seems to me, therefore, that your attempt to couch the threat to "... blow ... " mr. solomon's head off with a shotgun within the context of performing permissible self defense of person or liberty is not terribly successful.

would you conduct within these pages be automatically deemed criminal? i am not saying that, as the elements of harassment and assault within washington's domestic law contain provisions that require an intended victim apprehend a genuine risk or reasonable probability that such actions be carried out either immediately, or within specified frameworks.

it is of relative certainty, however, that you have done nothing to establish any sort of legal cause or justification for threatening such behavior or harm to mr. solomon for any sort of conduct as described in his letter, and as posted in this comment section. you may or may not have had cause to take a certain amount of umbrage to mr. solomon's statement of intent, but you certainly had no legal justification for responding in the manner in which you did, directing a promise to him to blow his head off for the simple assertion that he would perform certain legal acts.

it is probably best, mr. marko, that you be more judicious with your language. in short, as my mama suggested to me on many occasions, you should probably "watch your mouth," and take care in what you say and how you say it.

In response to what Marco said: a bit too polarizing, maybe, and overgeneralizing, but there are some good points in there.

@jj: I seriously doubt you're actually a lawyer, but I'll give you the benefit of the doubt once you start capitalizing your sentences.

Re "case law changes": Even the current conservative Court won't turn over Texas v. Johnson. If they do, it's one of the saddest days in this country's history.

Re "entrapment": No, that is clearly not entrapment, even if it were a police officer doing it. All that Marco did is enable people to commit a crime. Entrapment is creating the desire for them to commit the crime for the sole purpose of being able to arrest them for a crime. Examples include an undercover cop pressuring someone into buying drugs or being the leader of a group and encouraging the members to harm somebody. Being somewhat of a dick and then telling people how to hurt him is not entrapment. To argue that it was would be assuming that the other people on this blog have so little self control that they have no free will in hurting people who are stupid on the Internet.

Re "citizen's arrest": Any attempt to arrest Marco like those advocated in these comments would be patently illegal. Citizen's arrests are valid for on the spot things, where citizens hold a criminal until the authorities can arrive. They are legal only at times when the authorities are not capable of making the arrest because they haven't arrived yet. A premeditated invasion of his home by a group of SEALs (by the way, I hope that anyone who gets that angry over something on the Internet isn't actually a SEAL--otherwise, I have grave worries about the mental health of our armed forces) would not be a valid citizen's arrest, because they could have called the cops.

Also, if they are making a citizen's arrest, they become agents of the government. Since it's obviously premeditated, it's illegal for them to break into his home (or even make an arrest) without a valid court-issued warrant. Or one of those quasi-warrant things that the conservatives created in violition of the Fourth Amendment. But yeah, they'd need one of those.

So, yeah, if the group of SEALs (whom, like I said before, I hope aren't really SEALs or else the military needs to do a better job of screening its special ops soldiers for anger issues) broke into his home over this, they would be there illegally and Marco would be legally entitled to defend himself, especially if they were armed and he felt in imminent danger of bodily harm.

Just to let people know, after I couldn't find anything on the "union rag" cited, I took the liberty of calling the UAW local in Kokomo, IN.. They tell me that their flag has stars... They didn't even know there was a flag available with Obama's image on it.
