wonder what they would think about my theories on gun ownership? laughing. one fellow went so far as to say that an n.r.a. piece saying that gun ownership was to prevent governmental tyranny was gun nut inspired lunacy, with no basis in fact.
apparently, this gentleman has never read the federalist papers, by alexand hamilton, james madison and john jay. this collection of essays, some 99 written to proselytize the adoption of our present constitution, is recognized by supreme court decisions as part of the original organic documents forming this country. hamilton, madison and jay are recognized as being authoritative to this day, on constitutional theory.

the federalist papers says precisely that the citizenry should possess arms, the better to prevent tyranny and the usurpation of rights and privileges held by citizens by an overreaching government. it further goes on to say that state militias might be considered a bulwark against such usurpation and tyranny. and, it says that a well armed citizenry is the best defense of the individual's rights.

blackstone, the most singularly recognized compiler of the common law, and an exponent of natural law, is recognized as having a seminal influence of the common law, and as having an inordinate influence upon colonial thinkers and politicians: no lawyer or intellectual would have had a complete library with blackstone.

the recent heller vs. washington d.c. opinion is bulwarked by, and is a bastion in defense of, natural law theory. the natural law thinkers, including blackstone, and most definately including john locke if not quite thomas hobbes, and presumably the federalists, held that citizens predated government, and that they gave up certain liberties in order to enjoy civil society, but that those rights arising in nature not directly ceded to the sovereign were retained to their benefit, purpose and exercise. among those rights were the right to be armed for self defense, emphasized very broadly in heller, and the right to resist the tyranny of an overreaching and overweaning sovereign.
these thinkers saw a compact between sovereign and subject, a series of reciprocal rights and privileges. they also held that when the sovereign violated those compacts, the subject no longer held any obligation of obeying the sovereign, nor any fealty towards him.
in other words, when the compact was broken, natural law sprang forth in full flower, and under natural law the citizen had the right to defend himself from attack and oppression, even as against the usurping sovereign.
as for the philosophical and legal basis for gun ownership in this country, that editorial writer doesn't know bupkis. in other words, he is as full of poop as a christmas goose.
i hope this hasn't been too boring, but the fact is, gun ownership is the bedrock protection exercise by a citizen against a tyrannical ruler, or clique of the same. any politicians with pretensions or aspirations toward tyrannical rule, had best remember that.
in short, they will have my guns when they pry them from my cold dead fingers. it is that simple.
