The leftist Islamic alliance spend  their limited energies  on shutting down the truth tellers.

"rabbi" Feinberg  has sent me a legal doc threatening  litigation jihad.  Specifically he takes issue with the word "crazy". I have attended many Pro Pali Arab rallys, CAIR rallys, KGIA press conferences, and the belligerent  "rabbi" is always there. Fighting for the jihad, threatening, bullying, blustering, screaming in your face. My favorite personal moment is when he screams NAZI! in my face all because I attend. (The Nazi moment is in the video below)

I stand behind my coverage as accurate. Feinberg wants to sue me? Good. I was at these events. He was physical, dangerous and abusive. I will not take the truth down or will I tell others that ran my reportage to take down their posts either. A real Jewish Rabbi does not hate Jews or Christians. A real Rabbi does not support Hamas who states plainly in their charter to destroy Israel. What's next? A lawsuit from Hamas for calling them savages?

Feinberg wants a fight. I am anxious for the discovery phase. Dying to know who he is connected to, who he works for and on whose payroll(s) he is on. We need to  further investigate his ties to CAIR et al.

I'm an attorney from Illinois. Our code of civil procedure contains a provision where a litigant can bring a motion for attorneys fees costs and expenses against an opposing litigant who brings a frivolous action where there are untrue statements in a pleading or the action is brought for an improper purpose or to be harrasing or vexatious. It is loosely based on the federal Rule 11. Most states have these provisions. They are under used. My experience is that good judges will grant sanctions in a bullshit case. And the good "rabbi" doesen't have much to stand on. The prospect of having to pay his own fees(nobody in his right mind would take his case on a contigent basis) and Pamela's fees should prove too risky. My suggestion is to have a NY lawyer write a letter back to his lawyer and threaten sanctions. Our provision lets us go after the lawyer, too. I have gotten sanctions against my opponents twice. They usually have the deeper pockets and the more they fought me the more I made off them.

I am an attorney in San Diego, California and have litigated many defamation cases. If this goes any further, I’m sure you will have a swarm of competent attorneys thrilled to represent you in the case. The availability of several complete defenses to a defamation lawsuit filed by Feinberg is obvious from even a cursory review of your coverage of this vile critter’s conduct: truth; opinion; fair comment; etc. If Feinberg isn’t bluffing and he really plans to sue, then he’s well beyond “crazy,” because he would be pursuing a case in which he has no chance of proving liability, while simultaneously walking into a propeller of discovery demands that you (as the defendant) could legitimately pursue. (Courageous and undaunted as always, it’s no surprise that you are looking forward to the discovery phase, in which you would have carte blanche to reveal the extent of Feinberg’s dastardly connections.) I hope it doesn’t come to that and that Feinberg and his attorney weasel away with their tails between their legs, but if there is a lawsuit filed, I have every confidence that you will clean that bastard’s clock.

There is a more specific point I wanted to raise beyond mentioning the standard defenses that are available to you. It pertains to the specific language in the letter itself and what it reveals about a strategy used by plaintiffs’ lawyers in defamation cases. I’m sure you noted that the letter makes absolutely no reference to Feinberg’s rabid activism and it is NOT because he is unaware of it. He makes no reference to it because he is carefully avoiding making any admissions that you could later use to argue the application of the “public figure” standard to his client.

Attorneys who are inexperienced in defamation law often fall into the trap of making too many statements in their cease and desist letters and pleadings designed to trump up their clients’ damages. If they spend three pages of the complaint listing how “well-respected” and “well-known” their client is “in the community,” and what a “sterling, noble reputation” they enjoy for their activism or public service, only to then allege HUGE damages to their reputation as a result of the defendant’s statements, they are walking into a trap that they have conceded the plaintiff’s “public figure” status. A finding that the public figure standard applies is CYANIDE to a plaintiff’s defamation case. It saddles the plaintiff with a virtually insurmountable burden of proof before liability will be imposed. When a judge rules that the “public figure” standard applies, it’s OVER. Interestingly, the seminal case on the “public figure” standard is New York Times v. Sullivan—this was the case where Ariel Sharon sued Time Magazine, alleging that their coverage of his conduct related to the massacres at the Sabra and Shatila refugee camps was defamatory. Although the jury concluded that the Time story included false allegations, they found that Time had not acted with “actual malice” and did not award any damages. (“Actual malice” is required if the plaintiff is a public figure.)

With that in mind, it is interesting to read the letter again. Notice that there is only the most vague reference to Feinberg’s “principles and causes,” and absolutely no assertions about Feinberg’s “standing” or “involvement” in the “community.” Most telling of all is the attorney’s reference to Feinberg as a “professional person,” clearly calculated to steer the claims away from the application of the public figure standard. In fact, the letter makes it sound like you launched a vicious attack against some random, anonymous vicar, living in a one-room shack in a remote countryside, ministering to a congregation of 20. The words in this letter were chosen very carefully; so carefully in fact that it reveals his lawyer’s knowledge of the greatest weakness of their case—that Feinberg’s “activism” (read: unapologetic allegiance to the enemy) has made him a voluntary and highly-visible participant in a debate about matters of public interest. Feinberg’s lawyer knows that a finding that Feinberg is a public figure (or even a “limited public figure” in a “narrow area of public interest”) will sink the case.

I just wanted to bring this to your attention because I am repulsed by Feinberg’s collaboration with the anti-semitic jihadists who will, in time, devour him. Furthermore, I hope Feinberg and/or his lawyer read this comment and understand that if they are foolish enough to try to silence you, your ardent supporters will be watching the discovery phase with big bowls of popcorn.

So, if you’re out there, Feinberg, BRING IT! Ms. Geller is not afraid.
