U.S. News and World Reports has given terrorists a heads-up by exposing a formerly clandestine government program that monitors radiation levels at mosques to intercept any nuclear material intended for use in a dirty bomb. The program makes perfect sense given that most terrorists are Muslims and mosques have proven to be prime storage locations for explosives and weapons, and for planning attacks. What Kuttner could learn from Lincoln

On Saturday in "Thinking about the Great Liberator" I wrote a little on Lincoln's exercise of the commander-in-chief's war powers during the Civil War. Wielding Lincoln as his club, left-winger Robert Kuttner coincidentally attacked President Bush in a column for the Boston Globe on Sunday: "What Bush could learn from Lincoln." At Discriminations, John Rosenberg commented on Kuttner's column: "What would Lincoln do? What Lincoln did."

My point was that Lincoln's construction of the war powers of the commander-in-chief belies much of the silly commmentary by liberals like Kuttner on Bush. I would enjoy reading Kuttner on Lincoln's defiance of Chief Justice Taney's order to free John Merryman on the ground that Lincoln's suspension of habeas corpus was unconstitutional. Lincoln respectfully disagreed and declined to honor Taney's order. I hope Kuttner will get around to writing such a column someday; he might learn something if he studies up enough to write it.

Lincoln enunciated his understanding of public necessity enhancing the constitutional powers of the president during wartime on many occasions, perhaps none so memorably as in his letter to Albert Hodges on the Emancipation Proclamation. After reading Sherry’s post on Judge Young's sentencing statement to the "shoe bomber," it gave me a moment to reflect on the freedoms we do have as Americans. It also reminded me to say thanks to all of you, “The Greatest Generation.” You endured the horrors of evil of the 20th Century. It was your self-sacrifices, sense of purpose, and perseverance that preserved the freedoms we enjoy today. We of the generations that followed often take these freedoms for granted and fail to give you the thanks you deserve. We have not been personally challenged as you were by the threat of global evil. The Cold War while threatening was abstract and distant.

Now that socialism (communism) has collapsed as a failed utopian ideology, the liberal left has lost direction. Given media outlets are somewhat left of center, I’m sure you have noticed the media has slip into providing, “Infotainment,” and seldom provides useful reasoned articles and programming. I hope this is not a true reflection of the American people but one of business necessity of the media conglomerates. They pander to the dark side of human curiosity with blood and gore to attract audiences. This is done for much needed ratings and circulation to generate profit - hence, “if it bleeds, it leads.” This sensationalizes and distorts the events of the day out of proportion and without perspective.

Our media may no longer be a relevant provider of information. A new communication medium is now emerging. People are interconnecting via The Net, blog sites, and email just as this letter. News of events, ideas, and thoughts are freely flowing, unimpaired by political boundaries, or constraints and biases of the editorial and corporate boardrooms. This new collective medium has little overhead and has less need to generate a profit. It attracts audiences on value of the content. There is an inherent self-righting ability that limits extremes of thought and flawed group think.

The media has failed us, in its duty to inform and educate the American people, with its shallow infotainment coverage of the War On Terror. The people need creditable reporting, so we can make intelligent decisions in the upcoming presidential election. Some in the media believe the American people are too stupid to understand the complexities of the day’s stories. There is little drive or reward for excellence in reporting that is driven by a sense of duty and responsibility. The media has drifted into pandering for audiences and avoids hard stories. Hard news stories require a lot of time, effort, and resources. Hard news coverage requires a commitment to educate the people, report the facts without editorializing and sensationalizing, provide details as to the credibility of its sources, and then let the people from the story, form and draw their own opinions and conclusions. I would strongly caution information providers and their media conglomerates never to underestimate the intelligence and creativity of the American people.

The news media has abdicated its role and journalistic responsibility given it by the 1st Amendment. The news media as we know it may no longer be relevant as the provider of our news. Our cherished 1st Amendment right should not be twisted to justify the interests of media conglomerates.

Islamofascisim is a great danger facing the world. It is time our generations, suck it up and realize what is at stake here. It’s time to put aside our café lattés and cafe mochas, and realize America is at war. This is not another Vietnam. We must win this war. Loosing is not an option. If the use of radiation scanners to detect bombs or bomb material *in a building* could be construed as a violation of the reference precedent...then wouldn't it also be forbidden to use scanners to detect the finished bomb *when it is being transported by truck* to the point of intended detonation?

By this logic, there is absolutely nothing we are allowed to do to defend ourselves in advance of an attack.

The US Supreme Court case referred to is Kyllo v. United States, in which a majority of the Court agreed that using an infrared scanner to image a private residence was a "search" for 4th Amendment purposes.

Although the law is arguably applicable to scanning for radiation in mosques or community centers, it probably isn't.

Typically, 4th Amendment cases turn on whether there was a "search" and whether it was "unreasonable." Warrantless searches are per se unreasonable unless there are some exigent circumstances (exceptions) which apply. An example of exigent circumstances is "hot pursuit" of a suspect into a dwelling.

Likewise, where there has been any intrusion or trespass, a "search" has occurred. However, merely "staking out" premises without trespassing is not illegal.

In Kylla, Justice Scalia wrote for the majority that, since a residence was involved, use of an infrared scanner, even if it merely recorded data passively, constituted a search which was per se unreasonable, as no exigent circumstances existed.

It is, to say the least, doubtful that two of the most conservative justices, Scalia and Thomas, who joined with the more liberal Ginsburg, Breyer, and Souter in the Kylla case SOLELY because a residence was involved, would arrive at the same conclusion based on the conduct which occurred here.

No exigent circumstances were at play in Kylla; nor was national security or the power of the executive at all implicated in that case.

But, what the F***? For the left, any spurious argument will do, so long as it perpetuates the din of bullshit accusations being leveled at the Bush administration.

Maybe it's just me, but does anyone else see a really big difference between marijuana cultivation in the basement and nuclear bomb making in the basement?

Using infrared scanners necessarily targets a specific structure as heat will not radiate from structures not containing the source. Also the radiant energy will not affect neighboring structures.

Nuclear radiation will be absorbed by neighboring structures and in turn radiate from them. Scanning for nuclear energy is much less specific initially. Once the radiation is detected, the exact location can be defined by higher and lower radition levels.

It's been my understanding that the government has always had the free and unlimited power to scan any type of radiation. It was traditionally land lines which were regulated, not wireless communications or radiation. Isn't that right?

Also, isn't it clear that new technology is now outpacing the law? The traditional concept of "wiretapping" has to be almost completely outmoded, with today's new communication devices.

I wouldn't be surprised that some kind of reverse "Bit Torrent" type of software exists, which first encrypts the message, then breaks it up into multiple components, and then it is re-assembled and decoded on either end of the communication. The government would have to collect a wide spectrum of data, then correlate, combine and decrypt it again to make an intelligible message.

I think we will find that the whole idea of "wiretapping" can't be applied to the current way espionage is conducted.

Most of those old geezers in Congress probably are more familiar with a rotary dial phone than they are the types of communcation devices our enemies are using.

Left-wing legal scholars are absurd and irritating, but I’m more concerned that government officials would leak this story to USNWR.

According to USNWR, the account was leaked by one or more of the officials associated with the federal radiation surveillance activity. These leakers claimed that they were concerned about the legality of the operation.

Of course, if they had sincere questions about legal issues, they could have reported their concerns to any of the following,
1. Their chain-of-command;
2. Their agency Director;
3. Their agency Inspector General; or,
4. The congressional committee with oversight responsibility.

Reporting to any of these entities would have allowed the program to be reviewed but kept it confidential. Instead these leakers brought the story to the MSM, insuring that it would receive maximum exposure and serve to discredit both President Bush and federal counter-terrorism efforts. One has to conclude that, to these leakers, attacking the President and his national security program was more important than protecting American cities from the kind of WMD attack which Iran has been threatening.

What is the alternate course of action favored by the MSM, the leakers, and presumably “legal scholars?” The Detroit Free Press offers one possibility. An article on reaction to the USNWR story closes with comments from Dawud Walid, director of the Michigan branch of Council on American Islamic Relations (CAIR). Walid condemns the radiation surveillance, calls fears that a Muslim could be planning a WMD attack in the U.S. "preposterous,” and suggests that, ‘the FBI should form working partnerships with Muslims rather than "snoop into the personal lives of Muslims indiscriminately."’

If there was a reading above the natural background level (I'm not talking residue radiation leftover from medical treatments) eminating from a residence, building, truck, RR car, or any other like item it would be time to go to RED ALERT(e.g. TREK) until its nature could be determined.

In the general view of "There's a bomb" example of the exigent circumstance exception, I think such a detection would necessitate a warrantless intrusion.

It might interest you to consider that the Court's "moderates," Kennedy and O'Connor, joined the liberal Justice Stevens in the Kyllo decision in opining that passive infrared monitoring of the residence didn't even constitute a "search" at all under the 4th Amendment.

Hence, even absent exigent circumstances, four out of nine members of the Court -- pre September 11 -- would have decided that setting up radiation monitors outside a mosque DOESN'T EVEN CONSTITUTE A SEARCH for 4th Amendment purposes. The point of my previous post was tha it's doubtful that either Scalia or Thomas would have gone with the majority had a residence not been involved in the Kyllo case.

Moreover, given the fact that national security constitutes "exigent circumstances," not to mention the fact that every President including Clinton and Carter has claimed the inherent constitutional power to authorize such activities, your comment is entirely absurd.

Whether one accepts or rejects the holding of Kyllo, there are vast differences between the constitutional implications of the government trying to detect you growing pot in your basement, and terrorists stowing nuclear materials in a mosque.
